1. About these Terms 

These Website Terms of Use (“Terms”) apply to your access to and use of kempe.com.au and any related pages we operate (together, the “Site”). By accessing or using the Site you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site. We operate Australia-wide; the Site is intended for Australian users, but may be accessed globally. 

2. Changes to the Site and these Terms 

All information on the Site and these Terms may be updated at any time without notice. Changes take effect when posted. Your continued use constitutes acceptance of the updated Terms. If you object to changes, discontinue using the Site immediately. 

3. Australian Consumer Law 

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Any limitations in these Terms apply only to the extent permitted by law. 

4. Information on the Site 

Content is provided in good faith for general information only. It may include technical or industry information relevant to Australia that could change over time. We use reasonable efforts to ensure accuracy, but make no representation that the content is complete, up-to-date or suitable for your purposes. Supply is subject to Kempe’s applicable commercial terms agreed with you in writing (for example, purchase orders or service agreements). Information on the Site does not constitute an offer or inducement and will not form part of any supply terms unless expressly agreed.

If you create an account or submit forms, you must provide accurate information and keep your credentials secure. You are responsible for any content you upload or submit and must ensure you have all necessary rights. You grant Kempe a non-exclusive, royalty-free licence to use that content for the purpose for which it was provided. Do not submit confidential information via public areas of the Site. 

7. Acceptable Use 

  • Do not interfere with or disrupt the Site, servers or networks. 

  • Do not introduce viruses, malware or other harmful code. 

  • Do not scrape, harvest, mine or otherwise extract content or data from the Site by any automated means. 

  • Do not use the Site for unlawful, infringing, misleading or defamatory purposes. 

  • Do not impersonate any person or entity, or circumvent security/access controls. 

8. Intellectual Property (Copyright & Trade Marks) 

8.1 Copyright 

Kempe is the copyright owner (or licensee) of all content on the Site. You may access and view the material. You may download, print and reproduce this material in unaltered form only (retaining this statement) for your private non-commercial use or for use within your organisation. All other rights are reserved. Any other use (including reproduction, distribution, adaptation or public display) requires our prior written permission, except as permitted by law. 

8.2 Trade marks 

The names, logos, business names, brands and trade marks appearing on the Site are the property of Kempe or its licensors. Access or use of the Site does not create or grant any licence or other right to use Kempe’s trade marks, copyright or other intellectual property except as expressly stated in these Terms. 

9. Third-party Sites and Tools 

The Site may link to third-party websites or use third-party tools. These are operated by others and we are not responsible for their content, accuracy or practices. Your use is at your own risk and subject to those third parties’ terms and policies. 

10. Privacy 

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). 

11. Marketing Communications 

If you opt-in to receive marketing, we may send you emails or messages in accordance with the Spam Act 2003 (Cth). You can unsubscribe at any time via the link in our messages or by contacting us. 

12. Warranties and Liability 

The Site is provided “as is” and “as available”. To the maximum extent permitted by law, Kempe excludes all liability for any loss, damage, cost or expense (including consequential loss, loss of profit, loss of data, business interruption) arising from your use of, or reliance on, the Site. Where liability cannot be excluded under the ACL, it is limited to re-supplying the relevant services or paying the cost of having them re-supplied. 

13. Indemnity 

You indemnify Kempe and its officers, employees and contractors against any claim, loss or liability arising from your breach of these Terms, your unlawful acts, or your misuse of the Site. Kempe Holdings Pty Ltd holds the benefit of clauses 12 and 13 in its own right and as trustee for each of its related bodies corporate and for their respective officers, employees and contractors. 

14. Security and Availability 

We use reasonable technical and organisational measures to protect the Site, but do not guarantee uninterrupted, secure or error-free operation or that the Site is free from viruses or defects. You are responsible for implementing your own safeguards (e.g., up-to-date antivirus). 

15. Governing Law 

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
